منذ صدور النظام الأساسي للمحكمة الجنائية الدولية في السابع عشر من تموز (يوليو) 1998 تتابعت الدراسات حوله للتبشير بمضمونه وحث الدول على الانضمام إليه، حتى بدأ انضمام الدول بمثابة شهادة حسن سلوك دولية.
وبغية تقديم مساهمة قانونية وسياسية تسلط الأضواء الموضوعية على البيئة السياسية التي ولد فيها النظام الأساسي وبصماتها عليه. ومن أهمها منح مجلس الأمن صلاحيات واسعة في التدخل المؤسسي في أعمال المحكمة، فضلاً عن قصور النظام الأساسي ذاته عن معالجة أخطر الجرائم كالعدوان. وتركزت هذه المساهمة عن طرح سؤال موضوعي مهم: هل يدخل نظام روما الأساسي للمحكمة الجنائية الدولية في باب هيمنة القانون لصالح الإنسانية أم يدخل في باب الهيمنة لصالح دولة أو بضعة دول على حساب غالبية دول وشعوب العالم؟
لقد تعاهد مؤلفا هذا الكتاب أن يضعا هذا السؤال، القانوني والسياسي المشروع، نصب اهتمامها الموضوعي في معالجة موضوعات المحكمة الجنائية الدولية ضمن ستة فصول، تبدأ بالخلفية السياسية والقانونية لتدويل المسؤولية الجزائية، وتشكيل المحاكم الجنائية الدولية وتشكيلات المحكمة الجنائية الدولية والجرائم التي تختص بملاحقة مرتكبيها وعناصر الجرائم وآليات التحقيق والمحاكمة لتنتهي بعرض تحليلي للواقع الموضوعي للمحكمة.
