Book Description
إن عبارتي (التصحيح) و(الترجيح) مصطلحان فقهيان، يقصد بالأولى منها ما صح نسبته من الأقوال الى الأمام أبي حنيفة رضي الله عنه، برواية كبار تلاميذه كأبي يوسف ومحمد بن الحسن. وأما الترجيح فيكون ما بين أقوال أصحابه الذين كانت لهم القدم الراسخة في الفقه، حيث تميز المذهب الحنفي عن سائر المذاهب الفقهية الثلاثة بأنه مذهب جماعي، وأن القضاء أو الإفتاء بمقتضى مذهب الإمام يتعين أن يكون بالقول الراجح في المذهب.
لذلك كله اقتضى أفراد هذين المصطلحين بمصنف يكون عمدة في هذا الباب: وقد وضع العلامة قاسم بن قطلوبنا الحنفي المتوفى سنة (879 هـ) فصنفه "الترجيح والتصحيح" على مختص القدوري، الذي يعتبر في مقدمة المتون المعتبرة في نقل المذهب، حيث عمد إلى ما ورد فيه من مسائل الخلاف بين أبي حنيفة وصاحبيه، وبين القول الصحيح المعتمد في المذهب. وظل هذا الكنز مطويا في خزائن المخطوطات حوالي خمسة قرون، حتى قيض الله تعالى الباحث الشيخ ضياء يونس فاختاره ليكون موضوع أطروحته العلمية لنيل درجة الماجستير، صدّر الباحث الكتاب بدراسة ذكر فيها بعض مناقب الإمام أبي حنيفة النعمان، وكيف دوّن مذهبه، وطبقات الفقهاء في المذهب الحنفي، وأنواع المسائل فيه، ثم الكلام على مختص القدوري إذ هو الأصل الذي اعتمد عليه مصنف "التصحيح والترجيح" للتعليق على مسائله الخلافية، وهو ما شكل مدخلا للكتاب، ثم أتبع الباحث هذا المدخل بدراسة حول الكتاب وقسمها إلى ثلاثة فصول: الأول فيه ترجمة للشيخ قاسم بن قطلوبنا ترجمة موسعة، وذكره لمكانته بين العلماء، وتفصيل القول بيان كتبه ورسائله. الفصل الثاني: وفيه دراسة علمية لكتاب "التصحيح والترجيح" وفيه ثلاثة مباحث: الأول أهمية الكتاب، الثاني حول مسألة الترجيح في المذهب الحنفي، والمبحث الثالث حول منهج المؤلف في كتابه. أما الفصل الثالث فهو دراسة وصفية لكتاب "التصحيح والترجيح" وتمّ فيه بحث الأمور التالية: تسمية الكتاب، تاريخ تأليفه، وصف النسخ المخطوطة المعتمدة في التحقيق، وأخيرا عمل الباحث في التحقيق.
