يعد موضوع علاقة السياسة الشرعية بالفتوى من المباحث ذات الأهمية البالغة في مجال السياسة وبحوث ودراسات السياسة الشرعية؛ حيث تتجلى الآثار المهمة للفتوى في أبواب الفقه المختلفة، من خلال بيان ظروف إنزال الحكم على الواقع (الفتوى)، وتأثرها بعوامل الزمان والمكان والحال والأعراف، وهذه الأبعاد الأربعة هي التي تضفي على الفتوى بعدها الرعوي السياسي المراعي للظروف المحيطة بالنص وتطبيقاته.
وتناولت الأطروحة المفاهيم الأساسية سواء تعلق ذلك بالفتوى، أم بالسياسة الشرعية، وكذلك ركزت على أهمية السياسية الشرعية ومصادرها، وتأثرها بالحال والزمان والمكان والعرف، وأيضاً تكييف العلاقة بين الفتوى والسياسة الشرعية، ودراسة الأحكام الثابتة والمتغيرة ومجال عمل كل منهما.
وقد اقتصرت هذه الدراسة على هذه العلاقة في باب المعاملات المالية فقط؛ وذلك لإبراز العلاقة بين الفتوى والسياسة الشرعية، في هذا الجانب الحيوي.
وقد جاء هذا الكتاب في فصلين وخاتمة وفق ما يلي: الفصل الأول: "مفهوم السياسة الشرعية والفتوى، والمعاملات المالية"، الفصل الثاني: "التطبيقات الفقهية للعلاقة بين الفتوى والسياسة الشرعية، في المعاملات المالية".
