يعد موضوع (علاقة السياسة الشرعية بالفتوى) من المباحث ذات الأهمية البالغة في مجال بحوث ودراسات السياسة الشرعية؛ حيث تتجلى آثار الفتوى المهمة في أبواب الفقه المختلفة، من خلال بيان ظروف انزال الفتوى على الواقع، وتأثرها بعوامل الزمان والمكان والحال والأعراف، وهذه الأبعاد الأربعة هي التي تضفي على الفتوى بعدها السياسي المراعي للظروف المحيطة بالنص وتطبيقاته.
وتناولت الأطروحة المفاهيم الأساسية سواء تعلق ذلك بالفتوى، أم بالسياسة الشرعية، وكذلك ركزت على أهمية السياسة الشرعية ومصادرها، وتأثرها بالحال والزمان والمكان والعرف، وأيضاً تكييف العلاقة بين الفتوى والسياسة الشرعية، ودراسة الأحكام الثابتة والمتغيرة ومجال عمل كل منهما.
وقد اقتصرت دراستي على هذه العلاقة في باب المعاملات المالية فقط؛ وذلك لإبراز العلاقة بين الفتوى والسياسة الشرعية، في هذا الجانب الحيوي، وأسأل الله العظيم السداد والتوفيق للجميع.
