لم يفرض الله سبحانه وتعالى الأمور العبادية على الناس إلا رحمة منه لهم كي تكون المشذب والمطهّر للنفوس والرادع لها والمقوم لها في هذه الحياة الدنيا المليئة بالمغريات والموبقات التي يصنعها بعض بني البشر، ولكي تكون الوسيلة المثبتة للناس على الدين في دنيا الأحزان والهموم والرزايا والمصائب، والسبيل إلى عالم آخر خال من كل تلك الرزايا والمصائب والمآسي، عالم سعيد كله نعيم بنعيم.
والوقف كسائر شؤون الإنسان العبادية لا يمكن أن تصبح مبرمة وصحيحة إلا إذا تحققت فيها الشروط التي وضعها المشرع الإسلامي، لكي لا تضيع عوائدها وفوائدها ومنافعها هباءً، وكي يتم الحفاظ على حقوق المنتفعين بها من أن تطالها أيدي الطغاة والظلمة والمنتفعين والناهبين، ومصادري المعروف والخير.
قام هذا الكتاب بتوضيح أحكام الوقف والشروط التي لا يمكن أن يتحقق الوقف إلا بتحققها من أركانه وشرائطه، ومقتضياته، وموانعه في ما يخص الواقف والموقوف عليه أو عليهم بشكل مفصل ودقيق، ولم يغفلوا حتى عن الصغير منها في هذا الشأن، كما هو ديدنهم في سائر أمور الإنسان العبادية والمعاملاتية.
