في سبيل وصول الإدارة لتحقيق أهدافها المخططة والمرسومة سواء في ميزانية الشركات أو موازنة الدولة-حيث دائماً ما تحتوي تلك الميزانية وهذه الموازنة على جزء مخصص لتنفيذ عقود الإدارة المختلفة-فإن تلك الإدارة تلجأ إلى عدة طرق حددتها القوانين واللوائح والأنظمة المعمول بها ومنها المناقصة العامة، الممارسة، الاتفاق المباشر (التفاوض، التلزيم).
ولجوء الإدارة إلى أي من هذه الطرق، مقيد بعدة إجراءات لا بد من الالتزام بها، سواءَ قبل طرح المناقصة أو أثناء طرحها أو بعد ذلك. ويترتب على المناقصة بعد ترسيتها إبرام عقود يفرغ بها مضمون المناقصة أو الممارسة أو الاتفاق المباشر. وفي جميع الأحوال توجد هناك التزامات وضمانات مالية سواءً قبل الإلتزام بالتعاقد أو أثناء الالتزام أو بعد الالتزام.
وباختصار فإنه يمكن القول أن المناقصة، والعقد، والكفالات، والتأمينات، وضمانات الإدارة، والتأمين على الأشغال والمشتريات، كل ذلك يصنف ضمن باب واحد يسمى (الضمانات) أو (ضمانات حماية المال) فإذا كان المال للدولة فإننا نقصد المال العام بمفهومه الواسع وإذا كان المال لشركة أو مؤسسة خاصة فإننا نقصد حقوق المساهمين أو مال عام الشركة والمؤسسة.
وبناءً على ذلك فإن الحديث في إطار عنوان هذا الكتاب يجب أن يبدأ من طرف تنفيذ الأشغال والخدمات الفنية وكذلك طرق الشراء بمعنى المناقصة والاستثناءات الواردة عليها ثم ينتهي بالحديث عن العقد مفهومه، وأطرافه، ومضمونه، وضماناته. يتم استعراض كل ذلك من خلال الدخول في الجوانب التقنية للقانون أي ما يسمى (بتقنيات القانون) وما يمكن فهمه على أنه النواحى العملية لنظرية المناقصة وما ينشئ عنها.
