إن اللجوء السياسي هو ظاهرة صاحبت الإنسان منذ بدء حياته على وجه الأرض، وتطورت بإستمرار مع تطور ظروف الحياة، ولا يتوقع لها الزوال ما دام هناك حكم القوي على الضعيف، وللأجنبي أن يتقدم بطلب اللجوء السياسي من داخل إقليم الدولة، أو في أماكن معينة تقع خارجه.
فالإعلان العالمي لحقوق الإنسان منح كل فرد حق طلب اللجوء في بلدان أخرى خوفاً من الإضطهاد، كما أن العهد الدولي الخاص بالحقوق الإقتصادية والإجتماعية والثقافية يعترف بأن لكل شخص بما في ذلك اللاجئين وغيرهم من الأشخاص المشردين، الحق في التحرر من الجوع، والحق في التعليم، والحق في أن يتوافر له ما يفي بحاجته من الكساء والمأوى، والحق في تحسين ظروفه المعيشية بصورة مستمرة.
من هذا المنطلق، جاء هذا البحث الذي تناول فيه المؤلف قواعد حماية اللاجئين في المعاهدات الدولية وبيان مدى مخالفة أعضاء المجتمع الدولي لهذه الأحكام، وقد جاءت هذه الدراسة في مقدمة وقسمين وخاتمة، القسم الأول: خصص لمعالجة اللجوء السياسي بين النظرية العامة والقانون الدولي، والقسم الثاني خصص لمعالجة التطبيقات العملية للجوء السياسي، وأخيراً كانت الخاتمة التي تتضمن فحوى ما درُسه طوال هذه الرسالة مع بعض التوصيات.
