يعتبر حفظ السلم والأمن الدولي أهم الركائز الأساسية لقيام مجتمع دولي متطور تسوده قيم العدالة والمساواة، خاصة بعد ما قاست دول العالم جميعها من ويلات الحربين العالميتين والتي شاركت فيها أغلب دول العالم، إلى جانب عدد غير قليل من الحروب الثنائية أو الثلاثية التي هزّت أسس السلام في عالمنا المعاصر.
ومن هنا، فقد جاء حفظ السلم والأمن الدوليين في مقدمة أهداف الأمم المتحدة، وهي مهمة أساسية عهد بها ميثاق الأمم المتحدة إلى مجلس الأمن، حيث منحه مجموعة من الصلاحيات والسلطات اللازمة للقيام بوظائفه، لا سيما سلطة اتخاذ التدابير المناسبة والملزمة في حالات تهديد السلم أو الإخلال به أو وقوع العدوان التي نص عليها الفصل السابع من الميثاق.
وعلى الرغم من ذلك، فإن مجلس الأمن لم يتمكن من مباشرة سلطاته المقررة في الفصل السابع بفاعلية إلا في حالات إستثنائية جداً، وذلك بسبب ظروف الحرب الباردة، ونتيجة استخدام المعسكرين المفرط لحق الفيتو، لكن الأمر اختلف بعد نهاية الحرب الباردة وسقوط المعسكر الشيوعي؛ حيث كانت أكثر المسائل التي أثارت الجدل والتساؤل في هذه المرحلة هي مسألة تزايد لجور مجلس الأمن إلى ممارسة سلطاته المقررة له بمقتضى الفصل السابع من ميثاق الأمم المتحدة، فبعد حالة من الشلل التي ميّزت نشاط المجلس أثناء الحرب الباردة، أضحى نشاطه كثيفاً بشكل لا مثيل له، وأصبح من المعتاد أن يصدر مجلس الأمن العديد من القرارات تطبيقاً لأحكام الفصل السابع من الميثاق وهو الفصل المتعلق بنظام الأمن الجماعي في شقّه العلاجي.
وبناءً عليه، تتناول هذه الدراسة الدور المتزايد لمجلس الأمن بعد انتهاء الحرب الباردة، وذلك من خلال تناول حدود سلطات مجلس الأمن في تطبيق أحكام الفصل السابع من الميثاق، ودراستها دراسة قانونية على ضوء النصوص الناظمة لها، وعلى ضوء مبادىء وأهداف الأمم المتحدة وعلى رأسها حفظ السلم والأمن الدولي وذلك بغرض تحديد أحكامها تحديداً مانعاً، لمعرفة متى تكون قرارات مجلس الأمن المتخذة بناء على الفصل السابع شرعية ومتى تكون غير ذلك. كما يهدف هذا الكتاب إلى معالجة الإشكال المطروح في أوساط الفقه الدولي حالياً، والذي لا يتعلّق فقط بحدود سلطات مجلس الأمن ومدى شرعية قراراته المتخذة بموجب الفصل السابع من الميثاق خاصة القسرية منها، وإنما ينصرف إلى تلك القواعد العامة التي يقررها مجلس الأمن والتي تطبّق بصورة دائمة.
