من بين التشريعات الإلهية في العقوبات بأنواعها، ما يُعرف بـ "الدية" ذلكم المبلغ المالي الذي يدفعه الجاني أو عائلته للمجني عليه أو أوليائه نتيجة ارتكابه جناية من الجنايات. وقد فصلت الشريعة الإسلامية أحكام الدية وجعلتها واضحة للناس وبيّنة لا غموض فيها، وطبقها المسلمون منذ عهد رسول الله صلى الله عليه وسلم إلى يومنا الحاضر.
في هذا الكتاب يحيط الدكتور سعدون الدايني بـ (أحاديث الدّيات والقصاص في الكتب الستة) ويقدم دراسة تحليلية لما جاء في الأحاديث النبوية وما استنبط منها فقهاء الأمة ممن يُرجع إليهم في القول والعمل، والغاية بيان موقف الشرع من القتول مما ورد في أقوال وتقريرات رسول الله سواء أكان القتل عن عمد أم خطأ أم شبه عمد، ولمعرفة هل للجاني مخرج شرعي إذا وقع في هذه الجناية؟ وهل لأولياء الدم طريق آخر يحصلون من خلاله على عوض عما خسروه بفقدهم صاحبهم، من دون أن يوغلوا في مزيد من القتل والثأر، وغيرها من المسائل التي تتعلق بالديات والقصاص.
ولمزيد من الإيضاح اتبع المؤلف في دراسته الأسس العامة للدراسة التحليلية، وطبقها على أحاديث الديات في كتب الفقه العامة، وكتب فقه الحديث لأغلب المذاهب الإسلامية مرفقاً كل رأي بدليله، مبيّناً الرأي الراجح معتمداً في ذلك على اقوال أهل العلم، وذلك بتقسيم الدراسة إلى سبعة فصول تناول فيها اسباب الدية، وأصولها ومقاديرها، وسقوط القصاص بسبب العفو ووجوب الدية، وتوارث الدية، وصفة القصاص. وأخيراً أحاديث متفرقة في الديات.
