ان فكرة القانون قد نشأت في المجتمعات القديمة قبل نشوء للدولة ، ان القانون يعكس حضارة المجتمعات ضمن بيئة كل مجتمع على حدة، وهو بذلك يتأثر باختلاف البيئة من حيث الزمان والمكان ، فالقانون الذي ساد في المجتمعات البدائية يختلف عنه في المجتمعات المتقدمة والمدنية ، فان لكل مجتمع من المجتمعات الانسانية ما يميزه عن غيره من خواص وتركيبة خاصة به ، تجعل لكل مجتمع يتخذ لنفسه وصف الدولة ، لا سيما ان الدولة تدار شؤونها من قبل مجموعة من الافراد يطلق عليهم اسم الحكومة ، ولا شك ان نظرية الدولة اصبحت منذ زمن اهم ما يستهوي الباحثين في شتى العلوم ، لاسيما على القانون بالدرجة الاولى ، لكون العلاقة التي تربط بين الدولة والقانون هي علاقة التابع والمتبوع .
