تحتل نظرية التعسف في إستعمال الحق أهمية كبيرة في عالم القانون عموماً وفي نطاق الإجراءات المدنية على وجه الخصوص، وهذه الأهمية برزت بعدما تشعبت أمور الحياة وإزدادت تعقيداً، إذ كثرت المنازعات وتعقدت سبل حلها واختلف الناس عما كانوا عليه من فطرة سليمة وإزدادوا رياءً ومكراً وباتت تظهر صور مختلفة من الإلتجاء إلى الحيل القانونية، والمراوغة ومحاولة طمس الحقيقة، وحل اللدد في الخصومة محل التسامح والتسليم بما هو حق وعدل.
وبما أن الإنسان كائن إجتماعي مدني بطبعه لا يستطيع أن يؤدي دوره في الحياة بمعزل عن أقرانه ولا يكون نافعاً وحده بل لا بد من التفاعل مع الآخرين أفراداً وجماعات، الأمر الذي يتطلب ويفرض تنظيم العلاقات بين الأطراف مما يعني الحد من حرية الأشخاص تجاه بعضهم البعض ليتحقق حدٍّ مرضٍ من المصالح المتعارضة لكل طرف مع تقديم بعضها على بعض تبعاً لأهميتها للجماعة والأفراد ومدى الإستفادة منها، لذا منع الأفراد من إقتضاء حقوقهم بأنفسهم وفتح أمامهم باب اللجوء إلى القضاء ليفصل في منازعتهم ويوفر لهم الحماية وشرعت الحقوق الإجرائية لتحقيق ذلك، إلا أنه في حالة إنحراف الأفراد في إستعمال الحقوق الإجرائية، فإنه لا بد من وسيلة تجبر ذلك الإنحراف وتعيده إلى نصابه المتفق عليه، وتتمثل الوسيلة التي تضبط إستعمال تلك الحقوق بنظرية التعسف في إستعمال الحق، لذا فإن موضوع هذه الرسالة يبحث في (التعسف في إستعمال الحق الإجرائي في الدعوى المدنية - دراسة مقارنة).
ولقد اقتضت الدراسة التعرض لتعريف الحق الإجرائي ثم بيان علاقته بالحق الموضوعي وشروط إستعماله التي تختلف بإختلاف الأشخاص الذين يباشرونه والمعيار الذي يضبط إستعمال الحق الإجرائي ويضمن عدم الإنحراف به عن غايته المشروعة، كما استلزمت الدراسة بيان ماهية التعسف في إستعمال الحق الإجرائي وبيان طبيعته القانونية وتمييز التعسف في إستعمال الحق الإجرائي من غيره من المظاهر في الدعوى والمعيار الذي يتحقق به التعسف.
