إن اللجوء إلى القضاء المستعجل من الأمور الأساسية والحيوية البالغة الأهمية بالنسبة للمتقاضين والمحامين والحقوقيين، بحيث أن الحاجة باتت ملحة إلى السرعة المستعجلة في رفع ضرر وحسم نزاع وإزالة خطر، إن القضاء المستعجل أصبح يشغل حيزاً مهماً في النزاعات وفي مختلف الدعاوى، له ميزته وخصوصيته وأطره وأهدافه ونطاقه، وهو يهدف إلى إتخاذ تدابير عاجلة ووقتية تقتضيها الضرورة للخروج من إتباع الإجراءات العادية الروتينية في المحاكمة التي قد تأخذ وقتاً طويلاً، إلى إتباع أصول خاصة بالقضاء المستعجل تتميز بإختصار المهل وسرعة البت في الدعاوى المستعجلة وفي التدابير الوقتية الإحترازية المطلوبة والإستعجال في التنفيذ.
