تحتل مسائل المسئولية في أيامنا أهمية بالغة، بل إن بالإمكان القول بأنها تحظى بأهمية لا تدانيها فيها أية مواضيع أخرى من مواضيع القانون، فالواقع أن كثرة الحوادث التي تنشأ عن الفعل الشخصي أو عن استعمال الأشياء، أو استخدام الآخرين، أظهرت الحاجة إلى البحث عمّن يتحمل وزر هذه الحودث.
فمن البديهي أنّه لا يمكن ترك ضحايا تلك الحودث يتحملون وحدهم ما أصابهم واعتبار ذلك سوء حظ صادفهم وأن عليهم قبوله. فالاعتبارات الاجتماعية والاقتصادية تأبى ذلك، كما أن مقتضيات العدالة تأباه وتنكره.
وهكذا تعيّن إيجاد الوسيلة التي تكفل مساعدة المضرورين وإعادة أموالهم إلى ما كانت عليه. أو، على الأقل، تقديم ترضية لهم تمكنهم من التعايش بما أصبح عليه حالهم.
ومساعدة المضرورين تقتضي أول ما تقتضي تعيين الحوادث التي تستوجب مساعدة أولئك الذين كانوا ضحايا لها. فلا شك، مثلاً، أن حوادث الطبيعة الصرفه تبقى عموماً خارج نطاق الجهد القانوني وتدخل- متى أتاحت الظروف- في نطاق المشاعر والمعونات الإنسانية، أو، متى وجدت التشريعات الخاصة، في دائرة الجهد الحكومي أو الوطني. فتهبّ الحكومات، مثلاً، ملزمة بالتشريعات الوطنية حيناً، ومتبرعة بدون تلك التشريعات أحياناً، لمساعدة مصابي الكوارث الطبيعية من زلازل وبراكين وانزلاقات أرضية وفيضانات نهرية أو عواصف بحرية، إلخ..
أمّا ما يحدث بفعل الإنسان، فلا يمكن أن يترك للنوايا الطيبة ولجهود التبرع. فالعدالة تقضي بأن يتحمل كل إنسان وزر أفعاله ومواقفه. وهنا يأتي دور المشرعين في تحديد ما هو الفعل الذي يوجب التدخل لمحاسبته ومن هو الفاعل الذي يجب أن يكون محل المساءلة. وإذ تعيّن هذا وذاك، ظهرت ضرورة تحديد طبيعة المساءلة المطلوبة، ما هومحلها، ما هو مضمونها، وكيف تترجم على صعيد العمل، وما هي ضوابطها، وكيف يُضمن التقيد بنتائجها والوصول إلى غاياتها؟ ذلك هو دور المسئولية، وذلك هو ما يناط بما تقوم عليه من قواعد وأحكام..
