لا شك أن التجارة أصبحت علماً محكوماً بالضوابط والقوانين التي لا يمكن الخروج عليها، خاصة وإن هذه القوانين تتضمن القواعد المتعلقة بالأعمال التجارية التي يقوم بها التاجر الفرد أو الشخص المعنوي. الجزء الأول من قانون التجارة البرية. يتناول الأحكام والقوانين المتعلقة بها حيث يعرض الباب الأول لمفهوم التجارة بوجه عام ويبحث من نطاق تطبيق قانون التجارة ونواحي تحديد العمل التجاري.
أما الباب الثاني فيبحث في الأعمال التجارية التي تعد بحكم ماهيتها أعمالاً تجارية برية وكذلك جميع الأعمال التي يمكن اعتبارها مجانسة لها لتشابه صفاتها وغاياتها. بينما يتناول الباب الثالث الأشخاص الذين تكون مهنتهم القيام بأعمال تجارية، والأفراد الذين يتعاطون تجارة صغيرة أو حرفة بسيطة ذات نفقات عامة زهيدة.
ويبحث الباب الرابع في المؤسسة التجارية التي تشمل على عناصر مادية وغير مادية تختلف بحسب الأحوال وهي الزبائن وجماعة المستفيدين والاسم والشعار كما يبحث في العقود المتعلقة بالمؤسسة التجارية وأحكامها.
