تعتبر الشفعة سبباً قانونياً من أسباب كسب الملكية العقارية نظّمه القانون لعلاج حالات معينة تنشأ بين المالكين المتعددين لعقار ما أو بين مالكين لعقارات متجاورة ... وهي وسيلة لكسب الملكية، كالبيع والهبة والمقايضة وسيلة من الوسائل القانونية لانتقال ملكية عقار من شخص إلى آخر ... ولكن السبب في كسب الملكية لا ينشأ من إرادة منفردة مقترنة بالإيجاب والقبول مع اكتمال شروط الرضى بين المتعاقدين كالبيع والمقايضة مثلاً، إنما ينشأ بحكم القانون، فهو سبب قانوني لاكتساب الملكية. صحيح أن إرادة الشفيع هي التي تحرّك العلاقة القانونية بين مشتري العقار والعقار والشفيع ... ولكن منذ اللحظة التي يُعلن فيها الشفيع، بإرادته المنفردة، رغبته باكتساب ملكية العقار المشفوع فيه، تتوقف إرادته ويدخل نظاماً قانونياً متكاملاً، هو النظام القانوني للشفعة.
وبالنظر أهمية حقّ الشفعة، فقد أفردت المؤلف هذا الكتاب لدراسته وذلك في قسمين: القسم الأول: تناول دراسة مفهوم الشفعة. القسم الثاني: خصص لدراسة مفاعيل الشفعة.
