وذلك من خلال البحث في النصوص القانونية التي تضمنتها النظم الأساسية للمحاكم الجنائية الدولية، والتي تنظم تكوين جهاز الإدعاء العام والصلاحيات والسلطات التي يتمتع بها، كذلك البحث في التأثيرات الخارجية؛ من قبل أعضاء المجتمع الدولي، على إختيار رئيس الإدعاء العام وطريقة عمله، خصوصاً من قبل الدول الكبرى المسيطرة في العالم، سواء المنتصرة في الحرب أو تلك التي لها نفوذاً واسعاً وكبيراً في العالم.
كل ذلك كي يتضح للقارئ الكريم مدى الحماية الدولية التي يمكن أن يوفرها القضاء الدولي الجنائي لأفراد المجتمع الدولي، من خلال ملاحقة كل من ينتهك قواعد القانون الدولي الإنساني أو القانون الدولي لحقوق الإنسان في العالم، خصوصاً وأن المحكمة الجنائية الدولية الدائمة تختص بمحاكمة الأفراد، وليس الدول، ممن يرتكبون تلك الإنتهاكات في أي بلد في العالم، سواء كانوا من القابضين على السلطة أو التابعين لهم أو المتعاونين معهم، أم ممن هم خارج السلطة ومعارضين لها
