شهد القانون الدولي جرا مواكبته للأحداث والوقائع الدولية والمحلية منذ نهاية القرن التاسع عشر إلى يومنا هذا، تطوراً كبيراً بسبب الحروب الدولية وما خلفتها من مآسي إنسانية هائلة والحروب الداخلية التي شهدت فضائع وإنتهاكات جسيمة لم تعد مقتصرة على الحدود لإقليم الدول، التي شهدت هذه النزاعات إنما أصبحت تهدد الأمن والسلم الدوليين فأضفيت الصفة الإنسانية على القانون الدولي، ولم يعد مقبولاً عدم الإكتراث بحقوق الإنسان وحرياته الأساسية، وإقتصار التشريع الوطني على حماية هذه الحقوق والحريات وقت السلم والحرب، حيث بذلت جهود دولية حثيثة لتقنين هذه الحقوق والحريات وقت السلم والحرب، حيث بذلت جهود دولية حثيثة لتقنين هذه الحقوق والحريات في مواثيق دولية وإتفاقيات ومعاهدات، تلتزم بها الدول وقت السلم وعند نشوب النزاعات المسلحة الدولية والداخلية وتوفير الآليات اللازمة للتنفيذ والمراقبة وصولاً إلى الحماية الدولية الجنائية، جاءت ترجمة للجهود الدولية التي بدأت بشكل جلي بعد الحرب العالمية الأولى وتسارعت وتيرتها بعد الحرب العالمية الثانية تكللت بمحكمتي نورمبرج وطوكيو، ورغم الإنتقادات التي وجهت إليهما بإعتبارهما محاكمة المنتصر للخاسر في الحرب وأنهما لم تنظرا في الإنتهاكات التي ارتكبتها القوات المنتصرة، ولآلية الإحالة إليهما من المنتصر إلا أنهما تعتبران من التطورات القانونية الدولية الجنائية المهمة، لإنفاذ العدالة الدولية الجنائية وحماية حقوق الإنسان والحريات الأساسية من الإنتهاك.
ورغم أنهما كانت محكمتين وقتيتين إلا أنهما ساعدتا على إنشاء المحاكم المؤقتة والمختلطة، مثل محكمة يوغسلافيا السابقة ورواندا وسيراليون وكمبوديا ولبنان وساهمتا في وضع قواعد النظام الأساسي للمحكمة الجنائية الدولية الدائمة.
