ولأن البحث التحليلي في أسباب الخلاف الفقهي، وتفاصيله ونتائجه، على المستوى التجريدي النظري، وعلى المستوى التطبيقي العملي، هو أمر تقتضيه طبيعة التناول المنهجي العلمي المعمق للخطاب الشرعي في مختلف تنوعاته ومكوناته وتمثلاته.
تأتي هذه الدراسة، من مركز نماء، يسعى من خلالها الباحث لتحقيق مقصدين أساسيين: الأول متعلق بتقديم رؤية نظرية لتحليل الخلاف الفقهي من خلال وضع مقدمات منهجية لذلك، والثاني معنيٌ بتنزيل تلك الرؤية على نموذج تطبيقي من الإجتهاد الفقهي المعاصر، وهو نموذج الفائدة البنكية، وهو نموذج غاية في الثراء بما يحمله من فرص لتحليل مدارك الفقهاء المعاصرين في التعامل مع المستجدات الفقهية وربطها بالثوابت التشريعية والمتغيرات الفقهية.
ومن منطلق الهدف الذي يسعى إليه مركز نماء في تعميق البحوث التحليلية المتعلقة بمختلف أشكال الخطاب الشرعي بشكل عام، والفقهي منه هنا بشكل خاص، حرص المركز على نشر هذه الدراسة لتجويد رسالته العلمية، ولتحقيق أهدافه المعرفية.
