لقد أحدث تفاقم الجريمة المنظمة في عصرنا الحالي خللاً في البنية الإجتماعية حيث دخلت البلاد أموال غير مشروعة وارتقت فئات من الناس جراء غسل هذه الأموال وهذه الجريمة لم يحسم بعد الجدل فيها، حيث اختلف الفقهاء والمشرعون حتى في تسميتها؛ فأطلق عليها البعض اسم الجريمة البيضاء، والبعض الآخر يسميها جريمة غسل الأموال، وآخرون يطلقون عليها تبييض الأموال، وعلى الرغم من تعدد هذه التسميات لهذه الجريمة إلا أن فحواها واحد، وهو إضفاء الصفة الشرعية على أموال ناتجة عن أفعال إجرامية مختلفة سابقة له، فجوهر عملية غسل الأموال هو قطع الصلة بين الأموال القذرة الناتجة عن أنشطة إجرامية متنوعة، وبين أصلها ومصدرها غير المشروع، وإضفاء الصفة الشرعية القانونية على هذه الأموال، وبهذه الطريقة يحاول أن يفلت المجرم من الملاحقة الجنائية مما يشجعه على الإستمرار في ممارسة نشاطه الإجرامي.
وبناء على ما تقدم، اختار الباحث أن يدرس المكافحة التشريعية لجريمة غسل الأموال في القانونين الإماراتي والماليزي دراسة تحليلية، من أجل التعرف على كيفية مواجهة هاتين الدولتين لهذه الجريمة التي يزداد خطرها بشكل مستمر.
