يتناول هذا الكتاب المشكلات التي يواجهها تنفيذ العقود الإدارية وآثارها القانونية فيتحدث عن نظرية القوة القاهرة La theorie da la force maleure (الفصل الأول)، ونظرية الصعوبات المادية غير المتوقعة La theorie des sujetions imprevues (الفصل الثاني)، ونظرية فعل الأمير La theorie du fait de prince (الفصل الثالث)، ونظرية عدم التوقع La theorie de l'imprevision (الفصل الرابع).
إن المبدأ الأساسي الذي يقوم عليه القانون الإداري هو مبدأ استقلاله عن القانون المدني حتى أصبح له ذاتية خاصة. يعني ذلك أن القاضي الإداري يخرج بكل حرية، وحسب حاجة الحياة العامة، قواعد القانون الإداري دون أن يكون مرتبطاً بنصوص القانون المدني.
إلا انه لا يمانع في تطبيق ما يستبين منها انه منسجم مع الحاجات المذكورة ولو أنها تستجيب لحاجات القانون الخاص. وهو في الوقت ذاته سيد هذه النصوص بمعنى أنه يستطيع أن يكفيها ليستخرج منها الأحكام المطورة الموافقة لتطلعات الحياة الإدارية.
