يكتسب الإثبات في المواد الجزائية في مختلف العصور التأريخية أهمية كبيرة، والغرض من الإثبات في الدعوى الجزائية هو إقامة الدليل على وقوع الجريمة ونسبتها إلى شخصٍ معين فاعلاً أصلياً أو شريكاً.
ويتجه الفقه الحديث إلى أن الإثبات قد مرَّ بخمسة عصور هي عصر الفطرة والعهد الديني وعهد الأدلة القانونية وعهد الأدلة الإقناعية وعهد الأدلة العلمية حيث أن هذا العهد لا يقصر عمل الدليل على إثبات الجريمة بل يتعداه إلى تحليلها تحليلاً علمياً بالرجوع إلى الخبراء والإستعانة بالوسائل العلمية والفنية.
وتكتسب الخبرة في الوقت الحاضر أهمية كبيرة في الإثبات الجزائي، إذ أصبح الخبراء في مجال الإثبات الجزائي أمراً محتماً في كثير من الدعاوى الجزائية وذلك بسبب التطور العلمي والفني في كافة جوانب الحياة ومن بينها الجريمة، إذ أصبح الكثير من مسائل الإثبات منظماً بمقتضى قواعد علمية أو فنية أو تقنية مما يستحيل على القاضي مهما اتسعت خبراته النظرية والتطبيقية أن يحيط بكل ذلك.
ومن هنا، تبدو أهمية دراسة موضوع الخبرة في الإثبات الجزائي، فهي ذات أهمية كبيرة في نظرية الإثبات، حيث وجدنا بأنها لم تبحث بشكل علمي ومعمق وجاد على نطاق قطرنا، وإنما تم التطرق إليها ضمن مؤلفات وشروحات أصول المحاكمات الجزائية بشكل عام بعدة صفحات دون الإحاطة بشتات مشكلاتها.
والهدف من الخبرة هو وجود حالة يلزم لإثباتها معرفة خاصة، فالقاضي مهما اتسعت خبراته لا يمكن أن يبت فيها بمفرده من دون مساعدة الخبراء في كثير من المسائل الفنية.
