إن مسألة (الإعتداد بخلاف الظاهرية في الفروع الفقهية) مِن المسائل التي يَحتاجها الفقيه، وتعرِض له في مواضع عديدة، خصوصاً عند نظره في الخلاف العالي بين المذهاب الفقهية، فكثيراً ما يَتوقَّفُ الناظرُ عند بعض المسائل الفقهية التي انفرد بها فقهاءُ الظاهرية عَن جمهور الفقهاء من المذاهب الأربعة، وذلك بسبب إختلاف أصول هذا المذهب عن البقية بإعتماده على ظواهر النصوص، وعدم إعماله للتعليل والقياس؛ ولإغراب فقهاء هذا المذهب في الإختيار الفقهي حتَّى خالفوا كثيراً من الإجماعات المحكيَّة، وشُهِر عنهم ذلك، إضافةً لما في شخصية بعض المنتسبين لهذا المذهب وأعلامِه مِن التميُّز سَواءً في سَلاسَة العبارِة، وَقُوَّةِ الحُجَّة، أو في شدَّةِ التعبير على المخالفين؛ حتى قُورِنَت عبارتهم - أحياناً - بسَيفِ الحجَّاجِ شِدَّةً وبَطشاً.
كُلّ الأسباب تجعل بعضاً مِن طلاَّب الفقه والعلم يتوقَّف عند هذا المذهبِ وأصحابِه وقفةَ إعجابِ وإنبهارٍ أحياناً، أو حنقٍ وغيظٍ أحياناً أخرى، أو توسُّطاً بين ذلك توقفَ نظرٍ وتأمُّل.
فلذلك عَمَدَ بعضُ الباحثين لهذه المفردات فجمعها، واعتنى بدراستها؛ لكن مِن النَّاحِيةِ الفِقهية فَقَط.
