تحت عنوان "الباعث وأثره في تحديد عقوبة جريمة القتل العمد" يقدم القاضي "أياد أحمد سعيد الساري" دراسة مقارنة بين قانون العقوبات العراقي وبعض القوانين العربية والأجنبية معززة بالعديد من قرارات محكمة التمييز الإحادية في العراق.
ولأجل تحديد أكثر لتعريف الباعث على جريمة القتل العمد أو الذي هو بحسب المؤلف "العامل الذي يحمل الإنسان على فعل معين من السلوك، من خلال تحرك الإرادة لأحداث نشاط ينتج عنه فعل ذي مظهر مادي" وليكون الموضوع حاضراً في ذهن القارئ تم للمؤلف عرضه وفق خطة قسمها إلى أربعة فصول تتناول خلالها ماهية الباعث في جريمة القتل ودوافعه وظروفه؛ كما تناول بالشرح تمييز الباعث عن غيره من الأوضاع القانونية المشابهة؛ ثم صنّف البواعث من حيث طبيعتها "الباعث السياسي، و"الباعث العادي" و "الباعث الشريف" و "الباعث الدنيء" و "الباعث الوطني" و "الباعث الإنتقامي" و "الباعث العاطفي" أي أنه تناول أثر الباعث في عقوبة جريمة القتل العمد من حيث تخفيف العقوبة من عدمه، مثل "جريمة قتل الزوجة المتلبسة بالزنى، و"قتل الأم لوليدها حديث الولادة" و "القتل بدافع الشفقة" كما تم تناول أثر الباعث في تشديد العقوبة ومنها "جريمة القتل بباعث دنيء" و "جريمة القتل مقابل الأجر" .. وأخيراً تطرق إلى الأعذار والظروف القضائية وكيفية فرض العقوبة ...
هذا، وقد استندت الدراسة إلى كتب الفقه الجنائي المختلفة ومعلومات استقاها المؤلف من مصادرها الأصلية وعززها بالعديد من التطبيقات القضائية التي استقر علها القضاء في محكمة التمييز الإتحادية في العراق.
