حرمت الشريعة الإسلامية سب الأديان والإساءة لها بصفة عامة، وأوضحت موقفها من الإساءة لشخص الرسول صلى الله عليه وسلم، والبحث في أحكام الشريعة الإسلامية المتعلقة بهذا الموضوع يخرج عن نطاق هذه الدراسة القانونية، كما أن هناك العديد من البحوث المتخصصة التي نشرت بالفعل في هذا المجال. إلا أننا يجب أن نشير هنا إلى أن سماحة الشريعة الإسلامية تتمثل في أنها تحظر الإساءة للأديان السماوية بصفة عامة، ولا تقصر ذلك على الإسلام فقط، كما أن المفاهيم الأساسية للشريعة الإسلامية تدعو إلى تقديس الأديان السماوية والمساواة بين بني الإنسان، وهو الأمر الذي تبنته المواثيق الدولية السارية، التي سوف يركز البحث عليه في هذه الدراسة.
كما وتتركز الدراسة حول موضوع أساسي هو إثبات وجود قاعدة دولية تحظر الإساءة للأديان وبيان قواعد المسؤولية الدولية في حالة مخالفتها. وإثبات هذه القاعدة من ناحية السياسة الدولية على أي واقعة مثل قضية الرسوم المسيئة لن يكون بالعسير ما دام ما حدث من إساءات في رحاها يخالف النظام العام الدولي على النحو الذي سوف يحاول بيانه في هذه الدراسة.
وبالعودة لمتن الدراسة نجدها تنقسم هذه إلى ثلاثة محاور يعنى أولها ببيان موقف القانون الدولي من الإساءة للأديان، مع التطرق إلى مسألة على قدر كبير من الأهمية، وهي موقف القانون الدولي من حرية التعبير وحدودها. أما الثاني فيتصدى لتوضيح التزامات الدول ومسؤولياتها نحو قاعدة حظر الإساءة للأديان، بينما يختص المحور الثالث ببيان آليات مساءلة الدول عن الإساءة للأديان، لتعزيز الطابع العملي التطبيقي للدراسة فقد اقترح في هذا المحور استراتيجية للتصدي لقضية الرسوم المسيئة. وتنتهي الدراسة بخاتمة تحوي خلاصتها وأهم النتائج والتوصيات.
