يقصد بنظام القضاء مجموعة القواعد التي تحدد وجهات التقاضي في المملكة، وكيفية ترتيب وتشكيل المحاكم التابعة لكل جهة، وتبين الوضع النظامي للعاملين بهذه الجهات من القضاة ومعاونيهم.
ومن خلال هذه القواعد يمكن أيضاً إستنباط المبادئ الأساسية التي يقوم عليها النظام القضائي في المملكة، وتحديد المنازعات التي تدخل في إختصاص كل جهة من جهات القضاء، وتوزيع هذه المنازعات على المحاكم التي تتبع كل جهة من هذه الجهات.
وترتيباً على ما تقدم شملت هذه الدراسة لنظام القضاء الموضوعات الآتية: المبادئ التي يقوم عليها النظام القضائي في المملكة، ويقصد بها الأسس التي يرتكز عليها هذا النظام، كمبدأ إستقلال القضاء والمساواة بين المتقاضين وعلانية الجلسات ومجانية القضاء وغيرها.
كذلك تحديد الجهات التي تتولى ولاية القضاء في المملكة، وكذلك تحديد المحاكم التي تتشكل منها كل جهة، وترتيب درجات هذه المحاكم، وكيفية تشكيل الدوائر داخل كل محكمة، وتحديد إختصاص كل جهة من جهات القضاء، وتوزيع المنازعات التي تدخل في إختصاص كل جهة على المحاكم التابعة لها؛ وبيان الوضع النظامي لرجال القضاء وأعوانهم، وذلك بتحديد القواعد المتعلقة بتعيينهم وترقيتهم ونقلهم وندبهم وتأديبهم... إلخ.
وبناءً عليه، تنقسم الدراسة في هذا المؤلف إلى قسمين كبيرين على النحو التالي: القسم الأول: التنظيم القضائي، القسم الثاني: قواعد الإختصاص.
