إن وظيفة الفقيه المجتهد لا تقتصر على معرفة الأحكام الشرعية النظرية وإنما يضاف لهذه المعرفة بنفس الحكم جملة أخرى من المعارف اللازمة لفقه الأحكام ومناطات تنزيلها مثل التحقق من الوقائع المعروضة بظروفها وملابساتها، والتحقق من الشخص المكلف، وما يحتف بحالته من قرائن ومتغيرات، ومدى تحقق مقاصد الحكم الشرعي عند إجرائه، والتأكد من عدم بروز آثار جانبية ومآلات قد تنافي مقاصد الشارع العامة، أو مقاصد الحكم الخاصة، وهي الأمور التي تبرز أهمية وخطورة فقه الأحكام الشرعية فهماً وتنزيلاً، وشدة الحاجة إليه، حتى تكون الشريعة هادية لأفعال الناس وتصرفاتهم بما يحقق مصالحهم ويدفع عنهم الضيق والحرج.
ولأن الشريعة هي الموجّه لمجريات الحياة، ولا بد من تفعيلها في الواقع، وإثبات قدرتها على إستيعاب كل مجالات الحياة على مختلف الأزمان والبلدان، ولا يتأتى ذلك إلا بمعرفة منهجية فهم الأحكام الشرعية ومسالكه الشرعية، وكذلك معرفة منهجية التطبيق لتنزيل هذه الأحكام على محالها، ومرعاة حال الإختيار وحال الإضطرار على وجه يحقق الأهداف والغايات التي ترمي إليها، مع التأكد من عدم بروز مفاسد جانبية غالبة في الحال أو المال.
