مما لا ريب فيه أن الأدلة العقلية رسخ أساسها، وشمخ بنيانها، وعلا شأنها، وانتظم عقدها على دعائم الكتاب العزيز ومباحثه، وعلى هدى السنة النبوية وإرشاداتها، إلا أنها ليست كلها في مرتبة واحدة من حيث القيمة التشريعية، وإنما تتفاوت فيما بينها عند عرضها عليهما، فيقدم بعضها على بعض، لذلك اختلف علماء الأمة في معنى بعضها، والاستدلال بها، وتفريغ الأحكام عليها، وبحافز من هذا الاختلاف المتشابك الذي يحتاج لحل عقده وتجاوز معضلاته إلى جهد مضن، ووقت طويل، ومال كثير، عزمت بعد التوكل على الله، أن أشق متاهات هذا الموضوع، لعلي أستطيع بعد الدراسة المتعمقة، والتأمل الدقيق، أن أسبر غوره، وأنفذ إلى ما ورائه، وأبين أين ينبغي أن توضع الأدلة العقلية من الأدلة النقلية، وإلى أي مدى يمكن أن نبني عليها الأحكام، ونواجه بها تغيرات الزمان، التي تتطور باستمرار.
وقد جعلت هذا البحث في تمهيد وثلاثة أبواب وخاتمة تفاصيلها كالتالي (الباب الأول: القياس، الفصل الأول: معنى القياس، الفصل الثاني: حجية القياس أو التعبد بالقياس، الفصل الثالث: منزلة القياس من النصوص، الباب الثاني: أدلة تدخل تحت القياس بمعناه الواسع، الفصل الأول: الاستحسان، الفصل الثاني: المصالح المرسلة، الفصل الثالث: الذرائع، الفصل الرابع: استصحاب الحال، الفصل الخامس: الاستقراء، الباب الثالث: ما يتمسك به المستدل لتضمنه الدليل، الفصل الأول: الإجماع، الفصل الثاني: الأخذ بأقل ما قيل، الفصل الثالث: القول بالأخف والأثقل، الفصل الرابع: مذهب الصحابي).
