تناولت هذه الدراسة موضوع الآثار الشرعية والقانونية للضرر المعنوي، هادفة إلى توضيح التأصيل الشرعي في التعامل مع الضرر المعنوي، ومقارنة ذلك مع ما ذهب إليه القانون الوضعي من التعويض عن هذا النوع من الضرر، وذلك وفق المنهج الفقهي الإستقرائي التحليلي، ثم المقارن في دراسة للمحاور الرئيسة التي يتأصل بناءً عليها النظر في الآثار الشرعية والقانونية للضرر المعنوي، وذلك وفق القواعد والمقاصد التشريعية السامية التي تعنى بحفظ الحقوق المشروعة ورعايتها إحقاقاً للحق والعدل بين الخلق جميعاً.
هذا وقد عالجت هذه الدراسة موضوع الضرر المعنوي من خلال ثلاثة محاور: الأول: في بيان حقيقة الضرر المعنوي، بهدف توضيح أنواعه وخصائصه ومفهومه؛ لأن الحكم على الشيء فرع عن تصوره، ثم الثاني: في بيان قيام المسؤولية عن الضرر المعنوي شرعاً وقانوناً، بهدف إقرار تحمل التبعة والإلتزام عن وقوع هذا النوع من الضرر بشروطه وضوابطه، وأخيراً، الثالث: في توضيح الجزاء المقرر على قيام المسؤولية عن الضرر المعنوي؛ لأن قيام المسؤولية يستلزم وجود الجزاء المقرر عليها.
