يمكن القول أن أغلب التشريعات المدنية الحديثة قد استقرت على مبدأ التعويض عن الضرر الأدبي شأنه في ذلك شأن الضرر المادي. بيد أن الوضع إزاء هذا المبدأ لا يزال غير مستقر في السياسة التشريعية بالسلطنة.
وقد استعرضت الموضوع من خلال مبحث تمهيدي وفصلين فكان المبحث التمهيدي بمثابة مدخل للضرر الأدبي وذلك بالوقوف على ماهيته من خلال مطلبين، تناول المطلب الأول تعريف الضرر الأدبي، أما المطلب الثاني أوضحنا من خلاله خصائص الضرر الأدبي.
والفصل الأول من الدراسة، خصص لبيان مبدأ التعويض عن الضرر الأدبي في مبحثين. تناولت في المبحث الأول مبدأ التعويض عن الضرر الأدبي في النظام القانوني المقارن، والمبحث الثاني استعرضت فيه مبدأ التعويض عن الضرر الأدبي في النظام القانوني العماني.
أما الفصل الثاني من هذه الدراسة، تم تخصيصه لبيان أحكام التعويض عن الضرر الأدبي وتطبيقاته في مبحثين. تطرق المبحث الأول لشروط التعويض عن الضرر الأدبي وطبيعته، والمبحث الثاني تطرقت من خلاله لبعض تطبيقات تعويض الضرر الأدبي، وذيلت عجز هذه الدراسة بمجموعة من النتائج والتوصيات التي أنعم الله بها علىَ من خلال هذه الدراسة.
