لم تكن العلامات التجارية محل اهتمام المشرع حتى سنه 1939 عندما فكر المشرع المصرى بعد إلغاء الامتيازات الأجنبية من البلاد في وضع قوانين تنظم الملكية الصناعية. إلا أن المحاكم قد درجت على حماية الحقوق المتعلقة بالعلامات والبيانات التجارية كما فعلت بالنسبة لباقى حقوق الملكية الصناعية على أساس من العدالة والقانون الطبيعى ولقد رأينا التصدى لدراسة موضوع الترخيص باستعمال العلامة التجارية trademark licensing نظراً لأهميته من الناحية العملية. وقد تزايدت هذه الأهمية خلال السنوات الماضية بعد أن تطور استخدام العلامة فى المعاملات التجارية بشكل ملحوظ وتعددت صور وأشكال هذا الاستعمال فلم يعد الترخيص يقتصر فى كثير من العقود على استعمال العلامة فحسب، بل أصبح الترخيص باستعمالها يقترن بنقل المعرفة الفنيةknow - how أو حق من حقوق الملكية الصناعية. وتبدو أهمية الدراسة بالنظر إلى عدم وجود تنظيم تشريعى يتناول عقد الترخيص باستعمال العلامة، فهو عقد من العقود غير المسماه كما أن الموضوع لم يحظ بدراسات عربيه كافيه بالإضافة إلى أن القضاء المصرى فقير فى المجال. وسوف نقسم بحثنا فى الترخيص باستعمال العلامه إلى فصلين كالآتى: الفصل الأول: فى مفهوم الترخيص باستعمال العلامة ومشروعيته. الفصل الثانى: قواعد الترخيص باستعمال العلامة وآثاره.
