تؤدي الوساطة الجنائية إلى التخفيف عن كاهل القضاء، وتوفير الوقت والجهد والمال لأطراف النزاع، كما أنها تؤدي إلى رضاء نفوس المتنازعين بصورة قد لا يصل إليها الحكم القضائي، فتعمل الوساطة بهذا الشكل على تحقيق العديد من المزايا لأطراف المنازعة الجنائية (الدولة - المجني عليه - الجاني)، ونظراً لهذه المزايا، فقد أصبحت الوساطة الجنائية الأداة المفضلة في السياسة الجنائية، كما أوضحت بمثابة الوسيلة اللامعة في الإجراءات الجنائية، لذلك أخذت تشريعات كثير من الدول بنظام الوساطة الجنائية.
وقد ظهرت تجارب الوساطة في فرنسا في منتصف الثمانينيات من القرن العشرين، وكانت تحدث بناء على مبادرات من جانب رجال البوليس، وأعضاء النيابة العامة، وقاضي التحقيق، وحتى قضاة الحكم، وذلك على الرغم من عدم وجود نص تشريعي تستند إليه هذه الممارسات للوساطة الجنائية، ولقد كان للشريعة الإسلامية قصب السبق في تبني فكرة الوساطة الجنائية، حيث حثت عليها منذ ما يزيد على أربعة عشر قرناً، وخير دليل على ذلك قوله تعالى "وإن طائفتان من المؤمنين اقتتلوا فأصلحوا بينهما".
في ضوء ما تقدم، يتضح أن الإطار الذي يرسم معالم خطة البحث في هذا المؤلف يتحدد في شقين الأول يتعلق ببيان ماهية الوساطة الجنائية، والثاني يعالج الوساطة الجنائية في القانون المقارن، الأمر الذي يجعلنا نتجه إلى تقسيم هذه الدراسة إلى فصلين، وتتبلور الخطة الاجمالية لهذه الدراسة بناء على ذلك في الأتي:-
الفصل الأول: ماهية الوساطة الجنائية، الفصل الثاني: الوساطة الجنائية في القانون المقارن.
