تتمثل إشكالية البحث في كيفية إعمال مضمون إِسْتِشرَاف المُسْتَقبَل من خلال الفكر القَانُوني في مجال صِنَاعَة التَشْرِيعَات الخاصة مع إمكانية توظف الوسائل الحديثة والمبتكرة في عملية صِنَاعَة التَشْرِيعَات والخروج عن الأُطر التقليدية والتلقينية، وإستبعاد المناهج القديمة في ظل الإجراءات الجامدة لإصدار التَشْرِيعَات ومدى مواكبتها للمتغيرات، والتي بالمقابل تحمل بين طياتها جانباً كبيراً من المسؤولية، والموضوع برمته يحتاج إلى بحث وتحليل وتمحيص خاص بالإطلاع على ما تم عرضه عن نخبة من القَانُونيين وما تم طرحه من مجموعة رواد إِسْتِشرَاف المُسْتَقبَل وتنمية المجتمع للوقوف على تكوين إِسْتِشرَاف المُسْتَقبَل وتنمية المجتمع ومدى إعمال الأداة القَانُونية المتمثلة في صِنَاعَة التَشْرِيعَات ومدى موائمتها موائمة قَانُونية قابلة للتنفيذ والتطبيق على الواقع العملي مما يخدم ويلبي الهدف والغرض المنشأ له.
