تقوم هذه الدراسة على موضوعين: الأول: إجراء المقارنة بين القانون الوضعي والفقه الإسلامي لجهة القواعد العامة المتعلقة بالشركات، وبحيث يتبين ما بينهما من اتفاق أو اختلاف. الثاني: تحديد موقف الفقه الإسلامي من الشركات المساهمة، كونها شركات مستحدثة. ولقد اعتمد المؤلف في هذين الموضوعين على الدراسة المنهجية التالية: أولاً: عرض الأفكار والقواعد العامة في القانون الوضعي ثم عرضها في الفقه الإسلامي، ثم الانتهاء إلى نظرة مقارنة للخروج فيها بالتمرد المرجوة. ألا وهو معرفة مدى توافق القواعد العامة للشركات المساهمة في القانون الوضعي مع القواعد العامة للشركات في الفقه الإسلامي لاستخلاص الحكم الشرعي بشأن الشركات المساهمة المستخدمة في القانون الوضعي.
ثانياً: إن الشركات المساهمة هي جزء من الشركات السائدة في العصر الحديث، ولما كان القانون الوضعي الذي ينظم هذه الشركات ويضع أحكامها هو القانون التجاري، لذا كان لا بد للمؤلف من إعطاء صورة ومعالم عن هذا القانون حتى تكتمل الدراسة بدءاً من الأصل وصولاً إلى الفرع. ثالثاً: إن رسم معالم الشركات التجارية في القانون الوضعي والفقه الإسلامي استدعى من المؤلف التحريف بها وتحديد القواعد العامة لها وذكر أنواعها والمقارنة فيما بينها لكل من القانون الوضعي والفقه الإسلامي.
