أما بعد فانى لما رايت تصعب الأمر في تحفظ مسائل الخلاف على المتفقهة وفقهم الله تعالى لمرضاته. وتعسر طرق استنباطها عليهم وقصور معرفتهم عن الاطلاع على حقيقة ما خذها واشتباه مواضع الكلام عند التناظر فيها. جمعت في كتابي هذا. اخرفا إذا تدبر الناظر فيها وتأملها عرف محال التنازوع ومدار التناطح عند التخاصم فيصرف عنايته إلى ترتيب الكلام وتقوية الحجج في المواضع التى عرف انها مدار القول ومحال التنازع في موضع النزاع فيسهل عليهم تحفظها. ويتيسر لهم سبيل الوصول إلى عرفان ماخذها فامكنهم قياس غيرها عليها وذلك انى لما نظرت في المسائل التى اختلف فيها الفقهاء فوجدتها منقسمة على اقسام قمانية قسم منها خلاف بين ابي حنيفة رحمه الله وبين صاحبيه محمد بن الحسن وابي يوسف ابن ابراهيم الانصاري. وقسم ممنها خلاف بين ابي وابي يوسف وبين محمد بن الحسن رحمهم الله تعالى وقسم منها خلاف بين ابي حنيفة ومحمد وبين ابي يوسف رحمة الله تعالى عليهم اجمعين . وقسم منها خلاف بين ابي يوسف ومحمد رحمهما الله تعالى وقسم منها خلاف بين علمائنا الثلاثة محمد بن الحسن والحسن بن زياد وبين زفر رحمة الله عليهم اجمعين وقسم منها خلاف ين علمائنا وبين الامام الاقدم مالك بن انس رضى الله تعالى عنهم اجمعين. وقسم منها خلاف بين علمائنا الثلاثة محمد بن الحسن والحسن بن زياد وزفر وبين ابن ابي ليلى وقسم منها خلاف ين علمائنا الثلاثة وبين ابي عبد الله الامام القرشي محمد بن ادريس الشافعي رحمه الله. ثم جعلت لكل قسم من هذه الاقسام الثمانية بابا وذكرت لكل باب منه اصولا واوردت فيه لكلم اصل ضربا من الامثلة والنظاير واودعت في آخر هذه الاقسام الثمانية قسما آخر ذكرت فيه اصولا يشتمل كل اصل على مسائل خلافية متفرقه وما عدا هذه الاقسام الثمانية ممن اقوال المخالفين اعرضت عن ذكرها وايراد اصولها من اقاويلهم كراهة التطويل ولم اشتغل بشرح هذه الامثلة التى اوردتها الا قدر ما يتضح به اتصالها بالاصول التى ذكرناها.
