يعود اختيارنا لهذا الموضوع إلى انه لم يجظى عندنا في العراق باهتمام جاد. فالمشروع العراقي تارة يستعمل عبارة (النهائية) و تارة عبارة (القطعية) و تارة ثالثة يستعمل عبارة ( الحاسمة او الباتة). و قد اعتمدنا في البحث على افكار الفقهاء و ارائهم و النصوص القانونية و احكام القضاء. فاتخذنا من اسلوب عرضها ثم تحليلها و مقارنتها منهجا للبحث وذلك وفقا لما جرى عليه العمل فى العراق ومصر و الاردن و فرنسا. ولقد واجهنا صعوبات في مجريات البحث تجلت في كونها موضوعا لم يسبق بحثه بشكل مفصل. كما ان الدراسات التي تناولته لم تكن مستفيضة و متكاملة. سوى مؤلفات تناولته كمفردة في جملة ما تناولته من مفردات عدا احكام القضاء الاداري المصري التي جاءت غنية بالمبادئ المتعلقة بموضوع بحثنا. وبما ان بحثنا يدور حول صفة ( النهائية) في القرار الاداري. لذا كان حريا بنا تسليط الضوء على مفهوم القرار الاداري النهائي، وعلى هذا الاساس حاولنا دراسة هذا الموضوع دراسة موزعة على ثلاث فصول، ففي الفصل الاول تناولنا تعريف القرار الإداري النهائي مقسمين الفصل إلي ثلاث مباحث درسنا في الاول موقف التشريع من صفة النهاية في القرار الاداري ثم تناولنا في المبحث الثاني موقف القضاء من صفة النهائية في القرار الإداري. وفي المبحث الثالث تناولنا موقف الفقه من صفة النهائية في القرار الإداري. وفي الفصل الثاني بحثنا اهم خصائص القرار الإداري النهائي وتمييزه عما سواه، وفي المبحث الاول منه تناولنا خصائص القرار الإداري النهائي و التي تتمثل بكونه قرار تنفيذيا او قابلا للتنفيذ وكذلك كونه قرارا غير قابل للتصديق عليه من جهة اداريى اخرى. و غير قابل للرجوع فيه اخيرا القرار الإداري النهائي مؤثر في المراكز القانونية للافراد. فتمت دراسة تلك الخصائص في اربعة مطالب. وفي المبحث الثاني ميزنا بين القرار الإداري النهائي و الحكم القضائي اضافة إلى تمييزه عن القرارات المعلقة على شرط واقف او فاسخ. وفي الفصل الثالث تطرقنا إلى اثار القرار الاداري النهائي، مقسمين الفصل إلى مبحثين، الاول و يتمثل في امتناع الادارة عن السحب و الالغاء، والثاتي يتمثل في اكتساب القرار الاداري حجية الشئ المقدور به.
