هذا العمل هو خلاصة لمحاضرات ألقيت على طلبة قسم القانون في جامعة أربد الأهلية، وثمرة عدة سنوات من عطائنا وتدريسنا لمساق قانون العقوبات (2)، والذي يشمل موضوع الاشتراك الجرمي والنظرية العامة للعقاب. وهو يشمل على أربعة أبواب، تناولنا في أولها الاشتراك الجرمي، وتحدثنا في الثاني عن مفهوم العقوبة قمنا بالتعريف بها، وبيان خصائصها وأهدافها، ومقارنتها بالجزاءات الأخرى.
لكن حتى نوجد منهجاً للدراسة اتبعنا تصنيف العقوبات في القانون الأردني وتقسيمه للعقوبات حسب جسامتها إلى جنايات وجنح ومخالفات وبحثنا حسب جسامة العقوبة وشدتها أولاً في العقوبات البدنية، ثم في العقوبات السالبة للحرية، ومن ثم في العقوبات المالية، وخصصنا الفصل الرابع والأخير للتدابير الاحترازية، وتم تقسيمه وفقاً لمنهج المشرع الأردني إلى تدابير شخصية وتدابير عينية، وشرحنا كل تدبير بشروطه وأحكامه الخاصة به.
وتناول الباب الثالث الإعفاء من العقوبة والأسباب المخففة والمشددة لها، حيث شرحنا بشكل مفصل الأعذار القانونية المحلة والمخففة واستعرضنا الأحكام الخاصة بالأسباب المشددة والمخففة للعقوبة، وتناولنا بالشرح التكرار (العود) وتعدد الجرائم وأثره على العقوبة.
واقتضت طبيعة هذه الدراسة أن نبحث في الباب الرابع في أسباب سقوط الحكام الجزائية وقد تضمن انقضاء حق الدولة في تنفيذ العقوبة وأسباب زوال الحكم بالإدانة.
