تعد ظاهرة الإجرام من أخطر الظواهر الاجتماعية التي تهدد الكيان البشري في أمنه واستقراره، وبسبب خطورة هذه الظاهرة يهتم العلماء بدراستها اهتماماً كبيراً، ليكشفوا عن العوامل المسببة لها ويعملوا على معالجتها، وقد تمخضت هذه الدراسات عن علمي الإجرام والعقاب. ويعرف علم الإجرام بأنه: "العلم الذي يبحث في الجريمة، باعتبارها ظاهرة في حياة الفرد وفي حياة المجتمع، لتحديد وتفسير العوامل التي أدت إلى ارتكابها"، أما علم العقاب فهو يعرف على أنه: "علم معاملة المجرمين". وتبدو أهمية دراسة علم الإجرام والعقاب في أن مكافحة ظاهرة الجريمة في مجتمع ما تصبح أيسر وأكثر فاعلية، حيث تستند إلى فهم صحيح لأسباب تلك الظاهرة في هذا المجتمع، ولا شك أن معرفة الأسباب هي بداية الطريق الصحيح لعلاج الداء. ومن هنا كان موضوع كتابنا "مبادئ علم الاجرام والعقاب" محاولة للتعرف على أسباب الجريمة وطرق التصدي لها، لما لها من خطورة كبيرة من كافة النواحي، وعليه قسمنا كتابنا الى قسمين : القسم الأول علم الإجرام ونبحث فيه، تعريف علم الإجرام، وتحديد مضمون الجريمة والمجرم، ثم الوسائل البحثية التي يستعين بها علم الإجرام في استقصاء حقائق الظاهرة الإجرامية، كما يتم التعرف على عوامل الإجرام الداخلية والخارجية، اما القسم الثاني فقد خصص للبحث في علم العقاب ونتناول فيه دراسة الجزاء الجنائي، في القوانين الوضعية والتشريع الجنائي الإسلامي، والمدارس العقابية والفلسفات التي قيلت في شأن تبرير الجزاء الجنائي بصفة عامة، ثم دراسة المؤسسات العقابية، وأساليب المعاملة الداخلية والخارجية.
