هذا بحثٌ مهمٌّ في موضوع "العقوبة بالمال"، الذي نشطَ له المؤلِّف وأثبتَ أنه لا يُحكمُ بها في شريعةِ الإسلامِ، فلا يُعاقَبُ به مسلمٌ مهما فعل، فغن مالَهُ مصونٌ في الإسلام، ومن فعلَ فقد أكلَ مالاً بالباطلِ.
وبيَّن أن ما كان منها سابقاً فقد نُسخ، وعُقِدَ الإجماعُ من بعدُ على أنه لا عقوبةَ بالمال، ومن قال بذلك فقد خرجَ عن الإجماع، وخالف، مثل الهادوية (الزيدية)، والعلاَّمةِ ابن تيمية وتلميذه ابن القيم، وردَّ على من قال إن للمالكيةِ فيه قولاً بالجوازِ، على أن منهم من بيَّنَ الفرق بين العقوبة بالمالِ، والعقوبةِ في المالِ.
وكان الدافعُ له على هذا التأليف، هو رسالةٌ ألفها معاصرٌ له - لم يذكر اسمهُ ولا عنوانَ رسالته - أيَّد فيها جوازَ العقوبةِ بالمال، واستخرجَ من كتبِ الفقهِ أقوالاً لعلملاء تجيزُ مذهبه، فردَّ عليه، وأشارَ إلى تقصيرهِ في بعضِ ما نقلَ من حيث عدم إكمال الجملِ وما إليها.
