كان هناك العديد من الإعتبارات التي، دفعت كل من الدول العربية المختلفة (البترولية وذات العجز) الأعضاء في جامعة الدول العربية من ناحية والدول الأوروبية الأعضاء في السوق المشتركة من ناحية أخر، إلى الإتفاق المبدئي- في إطار الحوار العربي الأوروبي الذي بدأعام 1975 بين كل من المجموعتين العربية والأوروبية- على الخطوط الرئيسية اللازمة لإبرام اتفاقية جماعية للتشجيع والحماية المتبادلة للإستثمارا العربية- الأوروبية، تهدف أساساً إلى رفع الحد الأدنى للحماية الدولية للمال الأجنبي بما يحقق الصالح المشترك لدول المجموعتين.
ولا شك أن هذه المحاولة الأخيرة، أسوة بغيرها من المحاولات الأخرى التي أثمرت بالفعل وتمخض عنها اتفاقية دولة متعددة ثنائية كانت أم جماعية لتشجيع وحماية الاستثمارات الأجنبية، لخير دليل على عدم كفاية الحد الأدنى للحماية الدولية للمال الاجنبي كما هو مقرر في العرف الدولي للوفاء بالمصالح المشتركة لبعض الدول التي تربطها الرغبة في تحقيق المصالح المتبادلة.
وتدعونا هذه الملاحظة إلى التعرض للوسائل المقترحة لرفع الحد الأدنى الذي استقر عليه العرف الدولي في هذا الصدد، وهو ما نتولاه في الباب الثاني من هذا البحث والذي نتصدى فيه لرفع الحد الأدنى للحماية الدولية للمال الأجنبي وبناء على ما قدمناه تنقسم دراستنا في هذا البحث إلى بابين أساسيين: (الباب الأول: في الحد الأدنى للحماية الدولية للمال الأجنبي، الباب الثاني: في رفع الحد الأدنى للحماية الدولية للمال الأجنبي)، على انه قبل أن نبدأ في دراستنا على هذا النحو يحسن أن نقدم لها بفصل تمهيدي نعرض فيه للصور المألوفة لإجراءات أخذ الملكية الخاصة أو تقييدها.
