إذا كان الأصل العام الذي درج عليه المشرع الجنائي - كما سبق القول - هو عدم الإهتمام بوسيلة الإعتداء على المصلحة محل الحماية الجنائية، ولما كان المنطق السليم يقتضي أن يكون لكل إستثناء سبباً يبرره.
لذا فإنه يثار التساؤل بشأن علة تلك الإستثناءات التي أعطى المشرع فيها لوسيلة إرتكاب الجريمة أهمية خاصة في التجريم او العقاب، هل لأنه لا يمكن المساس بالمصلحة المحمية بغير الوسائل المحددة نصاً.
لم ينل موضوع الوسيلة حظه من الدراسة كموضع له إستقلاليته، إنما جاءت الإشارة إلى الوسيلة بشكل متفرق، وذلك بشأن بعض الجرائم التي حدد المشرع وسائل إرتكابها، أو تلك التي فرض لها عقاباً مشدداً بسبب إستخدام الجاني وسيلة معينة، لذا جاء هذا البحث محاولة لجمع ذلك الشتات مع التركيز على إبراز الأثر الخاص الذي يمكن أن تحدثه الوسيلة في مجالي التجريم والعقاب.
هذا الكتاب يعالج حالة إعتداد المشرع بالوسيلة، وللقول بأن المشرع يعتد بوسيلة إرتكاب الجريمة تعتمد في هذا البحث معياراً مفاده، أن تكون تلك الوسيلة قد استُعملت بشكل فعلي في إرتكاب الجريمة، إضافة إلى أنه يترتب على ذلك أثراً قانونياً خاصاً لا يرتبه إستعمال غيرها من الوسائل.
