في عمله هذه يجمع الشيخ "علي حب الله" العديد من النظريات القانونية والفقهية والتاريخية، إضافة إلى نصوص كثيرة وآراء في الفقه والقانون المقارن ويوليها عناية خاصة في شرح قانون المحاكم الشرعية فيما يختص أصول المحاكمات للطوائف: الجعفرية – السنية – الدرزية – العلوية. لذلك سيجد القارىء في هذا الكتاب بياناً وشرحاً لكثير من المواد الموجودة في أصول المحاكمات المدنية، أو الإحالة عليها، وهو أمر اقتضته طبيعة شرح قانون المحاكم الشرعية لأنه مستل منها برأي الكاتب.
وفي هذا الكتاب أفكارٌ جديدة في مجالي الفقه والقانون لم يألفها القارىء يعزوها مؤلف الكتاب إلى السياسة الشرعية والحسبة، وهي الآليات العملية التي تتحكم في منطقة الفراغ التشريعي، والأدوات التي يملكها الفقيه بناءً على القول بنظرية ولاية الفقيه، أو ولي الأمر. من هنا جاء هذا العمل ليس ثغرة مهمة في هذا المجال ... وفي هذا العمل يفرد مؤلف الكتاب بعضاً من النظريات الفقهية والقانونية ويتناولها شرحاً وتفصيلاً ويبيّن الأسس والغايات التشريعية المرادة منها كموضوع الزواج المؤقت، والتحكيم المطلق، ونظرية الظروف الطارئة ...
أقسام الدراسة: القسم الأول: قانون المحاكم الشرعية. الكتاب الأول: في التنظيم القضائي. ويضم خمسة عشر فصلاً نذكر منها: "أحكام عامة" ، "الفقه الإسلامي وقواعد حل النزاعات الناشئة في العلاقات الدولية" ، " في اختصاص المحاكم البدائية" ، "في اختصاص المحكمة الشرعية العليا" ... الخ.
أما القسم الثاني فجاء بعنوان: نظام القضاة الشرعيين. ويضم عشرة فصول نذكر منها: "أحكام عامة" ، "في التعيين" ، "المرتبات والترقية" ، "الأعمال غير المؤتلفة مع القضاء الشرعي" ، "الحصانة" ، "مجلس القضاء الشرعي الأعلى" ... الخ.
