يتناول هذا الكتاب الفسخ والإنفساخ والتفاسخ في ضوء القضاء والفقه وذلك بتناوله فسخ عقد الإيجار من خلال - دراسة تحليلية لحكم المحكمة الدستورية العليا الصادر بجلسة 22 /2 /1997 بشأن انتهاء عقد إيجار العين المؤجرة لمزاولة نشاط مهني أو حرفي أو تجاري أو صناعي لصالح الورثة بعد وفاة المستأجر الأصلي دراسة القانون الجديد بتعديل المادة 29 من قانون إيجار الأماكن رقم 49 لسنة 1977 تلافيًا لآثار حكم المحكمة الدستورية العليا والتعليق عليه. يتضمن دراسة تحليلية لمعنى الفسخ والانفساخ- وما يترتب على ذلك- ومتى يستحق التعويض في الحالات الثلاثة- ومدى انطباق ذلك على العقود الإدارية. أحدث أحكام محكمة النقض عامي 2004، 2005.
