منذ استقرار المذاهب الفقهية، فرض الفقهاء على القضاة الالتزام بأحكام تنسجم مع المذهب الذي يئتمون إليه. وحرصوا دوماً على اعبارها احكاماً شرعية إلهيّة، لا قوانين وضعيّة بشريّة.
في هذا السياق الإشكالي للخطاب الفقهي يتنزّل بحثنا لإشكالية الخمرة التي انعدم فيها المرجع النصّيّ القرآني الصريح، الأمر الذي أتاح استغلال النصّ أحياناً بتأويل مخصوص حدّدته نوعيّة العلاقة التي يريد أن يقيمها المتعبّد مع خالقه بواسطته. فبرز صنفان من المسلمين:
- من يعتقد بتحريمها على نحو ما رسّخته السّنة الثقافيّة والعقيديّة والأحاديث المتواترة عن النبيّ والصحابة في تحريم الخمرة وتحريم صنعها والإتجار بها.
- وصنف آخر من الناس ممن تمسّكوا بشرب الخمرة، ويعيشون تمزّقاً بين سلطان الرغبة وسلطان العبادة والتقوى.
انطلقنا في معالجتنا لإشكاليّة الخمرة من الفرضيّة التي تبني المسافة الفاصلة بين انتظام الحكم في النصّ القرآنيّ وانتظامه في المصنّفات الفقهيّة، وتأخذ في الحسبان المعادلة بين المقتضيات التي تتبنّى عليها غانية النصّ القرآنيّ ومقاصديته التي يتقوّم بها الاجتماع الإسلامي.
