Book Description
النقابة للإمام عبيد الله بن مسعود المحبوبي، متن اختصر فيه المصنف أحد المتون الأربعة المعتبرة عند الحنفية: "وقاية الرواية في مسائل الهداية"، الذي ألفه له جده الإمام تاج الشريعة محمود المحبوبي ليحفظه في أول نشأته. وقد استخلصه من مسائل كتاب "الهداية" للإمام برهان الدين المرغيناني، الذي هو أجل كتب الحنفية التي وصلت إلينا تحقيقاً وتمحيصاً، وأدقها في نقل مذاهب أئمتنا الحنفية تخريجاً وتلخيصاً.
ولما كان كتاب "النقاية" لباب كتاب "الوقاية" الذي هو لباب كتاب "الهداية": كان بحق لباب اللباب. ومن أجل هذا تبارى جهابذة فقهاء الحنفية في خدمته وشرحه، واستيفاء مقاصده وإظهار فرائده. وكان أعلاهم في هذا المضمار كعباً، وأبلغهم في نيل مقصده أرباً: المحدث علي القاري الهروي، فقد نظم في شرحه: "فتح باب العناية" المزايا المنثورة في كتب من تقدمه من الأئمة، مثل كتاب "المبسوط" للسرخسي، و"البدائع" للكاساني، و"الهداية" للمرغيناني، و"الاختيار" للموصلي، و"تبيين الحقائق" للزيلعي، و"شرح الوقاية" لصدر الشريعة، و"العناية" للبابرتي، و"البناية" للعيني، و"غنية المتملي" لإبراهيم الحلبي، و"حلبة المجلي في شرح منية المصلي" لابن أمير الحاج الحلبي، و"فتح القدير" للكمال بن الهمام، وغيرها.
بل يمكن أن يقال: إنه لخص فيه كتاب "فتح القدير" من معارك المناقشات والخلافات، ويسر أسلوبه، وفتح عبارته، وجاء به سهلاً سائغاً عذباً نميراً. كما أنه استخلص زبدة شروح "النقاية" التي سبقت شرحه هذا، فكانت شرحه حقاً: فتح باب العناية" وأفضل الشروح جميعاً، كما أنه أنقاها لغة، وأسلسها عبارة، وأوفاها استدلالاً، وأحسنها تعليلاً، مع امتيازه -إلى هذا المزايا- بعزو الأحاديث إلى مخرجيها، والأقوال إلى قائليها.
لهذا كان قارئه لا يجد نفسه محولاً بينه وبين فهمه، كما هي الحال في جل كتب الفقه، بل إنه ليرى هذا الكتاب وكأنه ليس فيه للغة العلمية والمصطلحات الفقهية الخاصة أي نصيب. ومن أجل هذا اختار "عبد الفتاح أبو غدة" خدمته فاعتنى بتحقيق متنه، حيث قان بمراجعة نصوصه ومقابلتها بمصادرها المنقولة منها وقابل الأحاديث الشريفة بأصولها، وصحح وأتمم ما وقع في كثير منها من تحريف أو نقص، وشكلها وفسر غريبها، كما شكل الكثير من كلمات المتن، وفصل جمله، وجعله مقاطع قصيرة، عوناً للقارئ على الفهم ويسر القراءة، وعلق عليه ما يتمم مقاصده، ويستكمل مباحة دون إسهاب، وخرج الأحاديث التي أغفل الشارح تخريجها.
