إن الحقوق العينية العقارية تلعب دوراً مهماً في الحياة الاقتصادية، فهي تمثل قيمة كبيرة بالنظر لكونها متصلة بالاساس بشيء ذات قيمة كبيرة ألا و هو العقار. وقد يقوم صاحب الحق العيني العقاري بالتعهد بنقل الحق الى الغير. ولا يوجد في القانون العراقي تنظيم شامل لموضوع التعهد بنقل الحق العيني العقاري، حيث أن المشرع العراقي أفرد التعهد بنقل حق الملكية وحق التصرف في العقار بتنظيم خاص وترك ما عداهما دون تنظيم، وذلك على الرغم من أن التعهد بنقل الحق له أحكام خاصة ويتميز عن غيره من التصرفات، كما تترتب آثار معينة على الإخلال بالتعهد، ولا بد من تنظيم تلك الآثار من قبل المشرع على نحو دقيق بحيث لا يترك الامر لتحكم القضاء، ويكون كفيلاً بالردع عن الاخلال بالتعهد بنقل الحق العيني العقاري. وتهدف هذه الدراسة الى تقييم المعالجات القانونية القائمة لموضوع التعهد بنقل ملكية العقار وحق التصرف فيه، وذلك بالنظر الى أن التطبيق العملي أثبت قصور تلك المعالجات في العديد من النواحي. كما وتهدف الدراسة الى ايجاد تنظيم شامل لموضوع التعهد بنقل الحق العيني العقاري في القانون العراقي، وذلك على اعتبار أن التنظيم الحالي لا يتسع إلا لكل من التعهد بنقل ملكية العقار وحق التصرف فيه، وأنه لا يمكن مد تلك المعالجات الى باقي الحقوق العينية العقارية بالنظر الى صراحة النصوص القانونية القائمة في الاقتصار على التعهد بنقل ملكية العقار وحق التصرف فيه فحسب، يضاف الى ذلك وجود تفاوت كبير بين حق الملكية العقارية وحق التصرف من جهة وباقي الحقوق العينية العقارية من جهة أخرى، إذ أن مضمون كل من حق الملكية العقارية وحق التصرف يتعلق بقيمة الأرض، وذلك بخلاف الحقوق العينية العقارية الأخرى.
