إن الدول النامية والتي تمتاز أغلبيتها بأنظمة سياسية غير ديمقراطية تعاني بصورة كبيرة جدًا من ظاهرة الفساد وذلك بسبب الفجوات التي تعاني منها هذه الدول من الناحية القانونية والسياسية والاقتصادية بحيث تجعلها ملاذًا أمنًا لانتشار هذه الظاهرة الإجرامية بصورة أوسع، الأمر الذي يترتب عليه إخفاق الدولة في أداء مهامها وعدم قدرتها على تحقيق أهدافها وذلك لأن جريمة الفساد تمس كيان الدولة وأمنها الاقتصادي والسياسي والاجتماعي لذلك ما هو الفساد؟ وما هي أنواعه والأسباب التي تؤدي إلى بروزه؟ ومع خطورة وأبعاد هذه الظاهرة الإجرامية من الناحية القانونية والاقتصادية والاجتماعية والسياسية كيف تكون الحال إذا لم تتضمن قوانين ودساتير الدول نصوصًا تعاقب على هذه الجريمة وتحدد آلية مكافحتها داخليًا ودوليًا؟ في حالة عدم النص على تجريم هذه الظاهرة كيف يكون موقف الدولة تجاه النتائج التي تترتب على هذه الجريمة؟ والتي تهدد بنيان الدولة من الناحية القانونية والسياسية والاقتصادية والاجتماعية وما هي الآثار التي تترتب على جرائم الفساد على المستوى الدولي والوطني؟
كل هذه الفرضيات وغيرها من التساؤلات سنحاول أن نرد عليها في دراستنا هذه، من خلال خطة بحث تضمنت الفصول التالية: [الفصل الأول: مفهوم جرائم الفساد وأنواعه وأسبابه ودوافعه، الفصل الثاني: العلاقة بين نظام الحكم وظاهرة الفساد، الفصل الثالث: الآثار المترتبة على جرائم الفساد، الفصل الرابع: الوسائل القانونية من أجل مكافحة الفساد].
