يمتاز التشريع الإسلامي بكونه تشريعاً إلهياً، وضعه خالقُ البشر، العالمُ بما يصلحهم، وقد جاء وافياً بحاجات الناس في كل زمان ومكان، ومحققاً للمصالح التي عليها مدار السعادة في الدنيا والآخرة. ولأن الإسـلام يمثـل الديـن الخاتَـم، والنصوص التشـريعية محدودة بحياة المبلِّغ صلى الله عليه وسلم فقد أوكل أمر النظر في المستجدات والنوازل إلى المجتهدين من العلماء، وإذا كان المجتهدون متعبَّدين بإظهار ما يغلب على ظنهم أنه حكم الله في الواقعة، فإنه لا شك أن يقع التردد في نظرهم الاجتهادي أثناء دراسة الواقعة، وقد يتبدى للمجتهد خلال نظره اختلافٌ بين الأدلة، أو بين ما تُلحق به الواقعة، وهو ما يعبر عنه بـ’التعارض‘. وإذا كانت مستجدات الحياة تفرض نفسها على المجتهد؛ ليبين حكم الله تعالى فيها، فإن ’القياس‘ هو الآلية المنضبطة التي تتم بها مواجهة تغيرات المجتمع المستجدة. والقياس يقوم في جوهره على إلحاق فرع بأصل لعلة جامعة، ولا شك أن التردد في الإلحاق واقع بين المجتهدين، لاسيما مع تعقيد المستجدات، فتتفاوت نظرة المجتهدين فيها، فيختلفون في توصيف الواقعة أولاً، ثم في الأصل الذي تلحق به ثانياً. وفي هذا الكتاب تحاول المؤلفة تحقيق المقاصد التالية: 1ـ التعريف بالتعارض بين الأقيسة، وبيان حقيقته، والبيئة التي تصلح لوجوده. 2ـ بيان منهج الأصوليين في حلّ تعارضات الأقيسة. 3ـ إيراد نماذج عملية توضح منهج الفقهاء في حل تعارضات الأقيسة.
