لقي الفقه الإسلامي-على اختلاف مذاهبه وتنوع مشاربه-اهتماماً كبيراً من العلماء، فكثرت فيه المصنفات من المتون الموجزة إلى الحواشي والتقريرات المسهبة، فلا نكاد نجد موضوعاً مهماً لم تكن للفقهاء عنده وقفة، فكثرت المطوّلات وتعددت ميسّرة للناس أحكام دينهم، ومبيّنة لهم تكليفهم الشرعي، ومقابل هاته الوفرة من ما كتب من الفقه، نجد على النقيض من ذلك ندرة فيما كتب عنه، رغم أهمية عملية التأريخ للفقه لكونها ترسم لنا صورة لتطوّر الاجتهاد ومرونة هذا الدين واستمراريته.
ومن بين الكتب القليلة التي تعرّضت لهذا الجانب كتاب "تاريخ الفقه الإسلامي" للشيخ محمد علي السّايس الأستاذ بالأزهر الشريف. ومع أن الكتاب وضع أساساً لتغطية منهاج تاريخ التشريع الإسلامي للسنة الثانية بكلية الشريعة في الأزهر الشريف، إلا أن تلخيصه الجيد لنشأة وتطوّر الفقه الإسلامي أخرجه من الحيّز المدرسي الضيّق، ليدخله إلى المكتبة الإسلامية في صورة مرجع سهل المتناول عظيم الفائدة، لمن يرغب في تتبع مسيرة الفقه من بداياته إلى أن اشتدّ عوده واستوى على سوقه.
ولعل ميّزة الكتاب تكمن في حسن عرضه واعتماد المنهج التاريخي إذ قسم المؤلف تاريخ التشريع إلى أدوار ستة ابتداءً بعصر الرسول صلى الله عليه وسلم، ووصولاً إلى عصرنا الحالي، معرّجاً على أشهر رجالات كل عصر، متناولاً قضايا تركت بصماتها على الفقه الإسلامي كالاجتهاد والتقليد وأثر الفرق في التشريع ونشأة المذاهب الإسلامية، وأخيراً ترجم المؤلف لثلة ممن تركوا بصماتهم في حركة الفقه الإسلامي، ولقيمة الكتاب العلمية وفائدته المعرفية ارتأى "محمد فاضلي" إخراجه في هذه الطبعة محققاً، ومعلق له، ومخرج أحاديثه بالإحالة إلى أرقامها أو صفحاتها حتى تسهل مراجعته من قبل القرّاء.
