ظلت الشريعة الاسلامية تحكم البلاد الاسلامية "دار الاسلام", دون منافس حتى منتصف القرن التاسع عشر الميلادى " أواخر القرن الثالث الهجرى", ثم بدأت النظم الأوربية تنافس النظم الاسلامية وتزاحمها فى دار الاسلام, فوقع تصادم بين الحضارة الاسلمية والحضارة الاوربية, وكسبت الأخيرة الجولة الأولى فى هذا الصراع, ولكن إلى حين. فاصطبغت نظم الحكم والنظم القانونية واقتصادية وقانونية على غرار النظم الأوربية, و انحسر مجال الشريعة الاسلامية تنازعته الشريعة اللاتنية "القانون الرومانى" والشريعة الانجلو سكسكونية " القانون الانجليزى" فضلا عن الشريعة الاسلامية.
وإذا كانت الوحدة السياسية بعيدة المنال فى الوقت الراهن فإن توحيد القوانين فى البلاد العربية والإسلامية أمر مقبول وسهل التحقيق بل أصبح ضرورياً للحفاظ على الهوية الإسلامية فى ظل العولمة. وفى ضوء ما تقدم تتحدد خطة الدراسة على الوجه الآتى:- نخصص الجزأ الأول لدراسة مصادر الشريعة الإسلامية ووسائل تطورها, وهى دراسة موجزة تهدف فى المقام الأول الى بيان أساليب تطور الشريعة ومرونتها بما يجعلها قادرة على تنظيم المجتمعات الإسلامية المعاصرة, ودور ولى الأمر فى حمل الناس على أمر معين. وندرس فى الجزأ الثانى تلاقى الشريعة الإسلامية مع القانون الرومانى بعد فتح البلاد التى كانت خاضعة لنفوذ روما حتى نتبين خصائص الشريعة واستقلالها بالمقارنة بالشرائع العالمية الأخرى وخاصة القانون الرومانى.
