إن ثورة الإتصالات، أي السرعة الهائلة لتفوق المعلومات في عصر الأجواء المفتوحة ليست قاصرة في تأثيرها على الصحافة وحدها، بل تمتد لتشمل كل وسائل الإعلام المسموعة والمرئية والمكتوبة.
لقد نمت التجارة الدولية في غضون العشرين سنة الأخيرة لدرجة أن مفهومها بدأ يتغير بشكل ملحوظ، وظهرت إلى جانب الأشكال التقليدية للبيوع والإيجارات ومبادلات البضائع، علاقات تعاقدية جديدة تنصب أساساً على بعض المواضيع الحديثة التي تتعلق بالتكنولوجيا المتطورة كالبث الفضائي عبر الأقمار الصناعية.
وإذا كان نقل البث الفضائي ليس وليد هذا القرن، إلا أنه قد أخذ إطاره التنظيمي خلال سنوات هذا القرن الحالي، فأصبحت هذه العلاقة التجارية التعاقدية تأخذ شكلاً قانونياً يحتوي على نقل خدمات متعددة، كحقوق البث الفضائي، بالإضافة إلى الحق في تلقي الأحداث والصور بشكل يصبح بمقتضاه الطرف الثاني في هذه العلاقة أي المتلقي للبث يمتلك الحق في الحصول على أفضل وأحدث أنواع البث المقدم.
وتأتي أهمية هذه الدراسة في أنها سعت إلى إتاحة الإفادة من المشاكل القانونية التي تنشأ عن عقود البث الفضائي عبر الأقمار الصناعية، وقد تطرقت المؤلفة إلى نقاط كثيرة لا تزال مبهمة ومحاطة بالغموض والتساؤل، نظراً لكون الموضوع قد تخطى من حيث الحداثة حدود الأرض إلى الفضاء وما يحويه من آلات وضعها الإنسان لتطوير الحياة من خلال إستعمال الفضاء ضمن قوانين أرضية، وهي الأقمار الصناعية، وتنبهنا هذه الدراسة إلى دخول الوسائل التكنولوجية كعنصر رئيس في السيطرة على حياتنا.
ونظراً لقلة الدراسات والأبحاث الفقهية التي تناولت هذا الموضوع الشائك والمعقد، فقد حاولت المؤلفة معالجته من الناحية العملية والإبتعاد قدر الإمكان عن الناحية النظرية، ولتحقيق أهداف الدراسة فقد قسمت المؤلفة الكتاب إلى قسمين: القسم الأول: ماهية عقود البث الفضائي، القسم الثاني: وسائل حماية عقود البث الفضائي.
